Legal ID cards for age verification
- The customer must present a physical part, not a photo or cell phone.
What identification can be used to identify a person and confirm their age?
Article 13.1 second paragraph of the Tobacco Control Act, which stipulates :
« This proof must be in the form of photo identification issued by a government or one of its departments or by a public agency, bearing the name and date of birth of the person wishing to purchase tobacco or be admitted to such a place. »
Example;
- Quebec driver's license
- Quebec health insurance card
- Canadian passport
- Indian Status Certificate
- Canadian Forces ID card
- Firearms Possession and Acquisition Licence (PPA)
Visibility of tobacco and vaping products
Article 6.4. 2° The operator displays electronic cigarettes or other devices of this nature, including their components, accessories and packaging, in such a way that they can only be seen from inside the point of sale;
Promotion, advertising and packaging
21. The operator of a business, a manufacturer or a distributor of tobacco products may not:
(2) reduce the retail price according to the quantity of tobacco, other than as part of regular marketing by the manufacturer, or offer or grant the consumer a discount on the market price of tobacco;

Units
- 1 unit cannot be sold for less than $10 (with taxes in the $10)
What's a unit?
A unit is a product sold in a single unit, e.g. coil.
The only products not covered by law 44 are those whose pack contains more than 10 units, e.g. rolling paper.
If the customer only wants 1 product sold individually and it's less than $10, offer to take more to meet the $10 minimum. Otherwise, raise the price of the item to $9.99 before taxes, to meet the minimum. Explain to the customer that this is one or the other option.
